Terms of Service

Last updated: 16 April 2026

01Scope and Parties

These Terms of Service (the “Terms”) form a binding agreement between you (“you” or the “User”) and [Full legal name / Sole trader name](the “Provider”) for the use of the browser game Project BloodConq (the “Game”), available at [https://bloodconq.example.com], and all services connected with the Game (website, realtime chat, clan features). Together, the Game and the connected services are referred to as the “Service”.

Conflicting or supplementary terms of the User do not become part of the contract unless the Provider expressly agrees to them in text form.[BGB § 305 (2)–(3), § 305b]

02Conclusion of Contract

The user agreement is concluded when you register an account and expressly accept these Terms in the registration form. There is no right to conclude an agreement; the Provider may decline registrations without giving reasons.

Where you are a consumer within the meaning of § 13 BGB, the contract concerns a free-of-charge digital service. There is accordingly no right of withdrawal under §§ 312g, 355 BGB so long as the Service is provided free of charge. Should the Provider in future offer paid digital content (e.g. cosmetic items), a separate right-of-withdrawal notice will be provided at the point of sale.[BGB §§ 13, 312g, 355]

03Beta Status and Availability

Following the conclusion of the closed beta, the Service is being prepared for an open beta scheduled for 2026. During this phase features may be modified, temporarily withdrawn or affected by downtime without prior notice. Progress made during the closed beta is not carried over to the open beta; the open beta starts on a fresh world for all players.

The Provider will use reasonable efforts to maintain a high level of availability but does not warrant any specific uptime. Planned maintenance, software updates and exceptional events may temporarily limit access.

04Description of the Service

BloodConq is a server-authoritative browser MMO in the slow-tempo realtime-strategy genre. Players manage villages, train units, coordinate within clans, and resolve battles whose outcome is computed exclusively on the game server.

Use of the Service in its core scope is free of charge. Should paid items (e.g. cosmetics, premium features) be offered in the future, they will be clearly marked, ordered separately and accompanied by a right-of-withdrawal notice in accordance with §§ 312g, 355 BGB.

05Account and Credentials

5.1 Uniqueness and accuracy of information

Each natural person may operate one account only. Multi-accounts are permitted only if the Provider has expressly granted them. Information provided on registration must be truthful, in particular the email address, which is used for security and service notifications.

5.2 Confidentiality

The password and authentication token must be kept confidential and may not be shared with third parties. You shall notify the Provider without undue delay of any suspected unauthorised access.

5.3 Account sharing and trading

Permanent or repeated transfer of the account to third parties (account sharing) is prohibited. Sale, exchange or acquisition of accounts for monetary or any other valuable consideration is prohibited. The Provider reserves the right to suspend affected accounts without prior notice.

06Fair Play and Prohibited Conduct

The following conduct is prohibited and will result, depending on severity, in a warning, temporary or permanent suspension of the account, and/or termination:

  • Use of cheat software, bots, scripts or any other automated tools that influence gameplay
  • Exploitation of identifiable software defects (bug exploits) for personal gain; identified bugs must be reported to the Provider
  • Reverse engineering, decompilation or modification of the client beyond what mandatory law (e.g. § 69d UrhG) permits
  • Bulk requests against the API or the game beyond documented usage (denial of service)
  • Discriminatory, defamatory, sexualised, glorifying violence or otherwise unlawful content in chat, clan descriptions, player names or other user-visible areas
  • Spam, phishing or commercial advertising in chat or clan channels without the Provider's consent
  • Identity deception, in particular impersonation of an official role (moderation, support, development)

The Code of Conduct (/code-of-conduct) further specifies these rules and forms part of the agreement.

07User-Generated Content and Licence

To the extent that you submit content (player name, clan name and description, chat messages, shared reports), you grant the Provider a non-exclusive, sublicensable, worldwide licence, limited to the duration of the user agreement and to the extent strictly necessary for the operation, display, backup and moderation of the Service. Your underlying copyright and personality rights remain with you.

You warrant that the content you submit does not infringe the rights of third parties and complies with applicable law. You shall indemnify and hold the Provider harmless from any third-party claims arising out of content you submit, in particular claims based on infringement of intellectual property rights, personality rights or laws against unfair competition. The indemnity covers reasonable legal-defence costs.

08Suspension and Termination

8.1 Termination by the User

You may terminate the agreement at any time without notice by deleting your account through the account settings or by sending a notice to [privacy@bloodconq.example.com].

8.2 Termination and suspension by the Provider

The Provider may suspend the account in the event of material or repeated breaches of these Terms or the Code of Conduct, without prior notice where this is reasonable in the circumstances. Ordinary termination by the Provider requires a notice period of 14 days to the end of the month. The right to extraordinary termination for cause remains unaffected (§ 314 BGB).[BGB § 314, § 626]

Before suspension, you will normally be given an opportunity to be heard, unless delay would prejudice the protection of other users or the integrity of the Service. Reasons will be provided together with information on the internal complaint procedure (Section 9).[DSA Arts. 17(3), 20]

8.3 Effects of termination

On termination of the agreement, your account is deactivated and scheduled for deletion in accordance with the retention rules in the Privacy Policy. Server-authoritative game records (signed battle reports, command history) may be retained for the duration of the active world for the purposes of audit and evidence preservation. Any indemnities, liability limitations and the choice-of-law provisions survive termination.

09Internal Complaint Procedure (DSA Art. 20)

You may appeal moderation decisions (suspension, content removal, warning) within [6 months] of being notified of the decision, by email to [appeals@bloodconq.example.com]. The appeal will be handled by a person who was not involved in the original decision. We will issue a reasoned decision within [14 days] of receipt where reasonably possible, and in any event without undue delay.[DSA Art. 20]

Out-of-court dispute settlement under Article 21 DSA before a certified body remains available. The right to seek judicial redress is unaffected by this procedure.

10Intellectual Property

All rights in the Service, in its software, visual design, text, logos and other content remain with the Provider or its licensors. The User is granted a non-exclusive, non-transferable right to use the Service in accordance with these Terms.

11Liability

The Provider is liable without limitation for intent and gross negligence, as well as for damage resulting from injury to life, body or health. For simple negligence, the Provider is liable only for breaches of material contractual obligations (cardinal duties) — those obligations the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the contracting party regularly relies. In such cases, liability is limited to the typical, foreseeable damage at the time of the conclusion of the contract.

To the extent permitted by law, liability for loss of profits, indirect damage, consequential damage or loss of game data is excluded, unless one of the grounds of liability set out above applies. Liability under the Product Liability Act (Produkthaftungsgesetz) and the German Data Protection Adaptation and Implementation Act remains unaffected, as does any statutory liability that cannot contractually be limited.[BGB §§ 276, 309 No 7; ProdHaftG]

12Indemnification by the User

You shall indemnify and hold harmless the Provider, its officers, employees and agents from and against any third-party claims, including reasonable legal-defence costs, that arise out of (a) your breach of these Terms, the Code of Conduct or applicable law, (b) content you submit through the Service, or (c) your infringement of any third-party right, in particular intellectual property or personality rights.

You will be granted an opportunity to participate in the defence and to be heard before any settlement that imposes obligations on you. You shall provide the Provider, on request and without undue delay, with all information and documents reasonably required to defend the claim.

13Force Majeure

The Provider is not liable for any failure to perform its obligations to the extent that such failure is caused by an event beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, governmental or regulatory action, internet or telecommunications outages, denial- of-service attacks, large-scale cyber-attacks against critical infrastructure, and pandemics. The affected obligations are suspended for the duration of the event of force majeure; the Provider will inform you without undue delay and resume performance as soon as reasonably possible.

14Privacy

The categories of personal data processed and the purposes, legal bases and retention periods are set out in the Privacy Policy.

15Minors

The Service is not directed at persons under the age of [16]. Where minors register, the consent of the holder of parental responsibility is required, in particular for any processing of personal data based on consent (Art. 8 GDPR). On grant of a USK age rating prior to public launch, the age limit stated here will be updated accordingly.

16Changes to These Terms

The Provider may amend these Terms with effect for the future where this is necessary for compelling legal reasons, to adapt to changed technical conditions, or to remedy regulatory gaps. Material changes will be notified to Users at least 30 days before they take effect, by email or by a prominent in-game notice. If you do not consent to the amended Terms within the announcement period, you may terminate the agreement extraordinarily within that period. Continuing to use the Service after the effective date of the amended Terms constitutes acceptance of the changes.

17Final Provisions

17.1 Governing law

These Terms are governed by and construed in accordance with the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Where you are a consumer habitually resident in another State, the mandatory consumer-protection provisions of the law of that State remain unaffected (Art. 6(2) Rome I Regulation).[Rome I Reg. (EC) 593/2008 Art. 6]

17.2 Jurisdiction

For users who are merchants, legal persons of public law or special funds under public law, the exclusive place of jurisdiction is the place of business of the Provider. For consumers, the statutory rules on jurisdiction apply.

17.3 Severability

If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory rule, or, if no such rule exists, by an arrangement that comes closest to the economic intent of the invalid provision while remaining permissible under applicable law.

17.4 Language of contract

The contract is concluded in English. Translations into other languages are provided for accessibility only and are not authoritative. Where mandatory consumer-protection provisions of another Member State require communication in a different language, those provisions take precedence to that extent.

17.5 Assignment

You may not assign or otherwise transfer your rights or obligations under these Terms without the Provider's prior written consent. The Provider may assign its rights and obligations under these Terms to a third party where this does not materially affect the Service or your rights as a consumer.
